1. Acceptance of Terms

By downloading, installing, or using BiteVisor (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

These Terms constitute a legally binding agreement between you and BiteVisor. We may update these Terms from time to time as described in Section 15.

2. Description of Service

BiteVisor is an AI-powered weight management application that provides personalised meal plans, portion guidance, preparation instructions, calorie tracking, weight logging, step tracking, water tracking, exercise recommendations, an AI nutritionist chat, and community features including teams, challenges, and accountability buddies.

The Service is available on iOS and Android. Some features require a paid subscription as described in Section 5.

3. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use BiteVisor. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.

By creating an account, you represent that the information you provide is accurate and complete.

4. Account Registration

You must create an account to use BiteVisor. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate information and to update it as needed. We reserve the right to suspend or terminate accounts that contain false or misleading information.

You may not share your account with others or create multiple accounts for the purpose of circumventing subscription restrictions.

5. Subscriptions & Payments

BiteVisor offers three tiers: Free, Pro, and Premium. The Free tier provides limited access to core features at no cost. Pro and Premium are paid subscriptions billed monthly or annually.

Payments are processed through Google Play Billing (Android) or Apple StoreKit (iOS). We do not handle your payment information directly. Subscription status is managed through RevenueCat.

Prices are displayed in your local currency as determined by the app store. We reserve the right to change pricing with 30 days’ notice. Existing subscribers will be notified before any price change takes effect on their next renewal.

You may cancel your subscription at any time through your device’s subscription settings (Google Play Store or Apple App Store). Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.

Refund requests are governed by the refund policies of Google Play and the Apple App Store. Contact us at support@bitevisor.com if you need assistance.

6. Free Trial

We may offer a free trial period for Pro or Premium from time to time. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the advertised rate. Trial eligibility is determined by the app store and is typically limited to one trial per account.

7. Health & Medical Disclaimer

BiteVisor is a wellness and weight management tool, not a medical service. The meal plans, nutritional information, calorie targets, exercise suggestions, and AI chat responses are generated by artificial intelligence and are for informational purposes only.

You should consult a qualified healthcare professional before making significant changes to your diet or exercise routine, especially if you have pre-existing health conditions, eating disorders, are pregnant or breastfeeding, or are taking medication.

BiteVisor is not designed to diagnose, treat, cure, or prevent any disease or medical condition. We do not guarantee specific health outcomes. Use of the App is at your own risk.

If you experience adverse health effects while following a plan generated by BiteVisor, stop immediately and consult a healthcare professional.

8. AI-Generated Content

Meal plans, chat responses, calorie calculations, and nutritional advice are generated by artificial intelligence (Google Gemini). While we strive for accuracy, AI-generated content may contain errors, omissions, or inaccuracies.

We are not liable for decisions you make based on AI-generated content. You should use your own judgement and, when in doubt, consult a qualified professional.

AI-generated meal plans and recommendations are not a substitute for the advice of a licensed dietitian, nutritionist, or medical practitioner.

9. Community Guidelines

When using community features (posts, teams, challenges, accountability buddies), you agree to:

Be respectful and supportive of other users on their health journeys.

Not post content that is harmful, abusive, harassing, defamatory, sexually explicit, or promotes dangerous health practices (extreme restriction, purging, or unproven supplements).

Not share personal medical information of others without their consent.

Not use the community to advertise, spam, or promote products or services.

We reserve the right to remove content and suspend accounts that violate these guidelines without prior notice.

10. Acceptable Use

You agree not to: reverse-engineer, decompile, or attempt to extract the source code of the App; use the App for any unlawful purpose; share your account credentials with others; attempt to circumvent subscription restrictions or feature gates; abuse the AI chat system by sending harmful, abusive, or spam content; use automated tools to scrape data from the App; or impersonate another user or a healthcare professional.

11. Intellectual Property

All content, design, code, AI models, and branding within BiteVisor are the property of BiteVisor or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes.

Meal plans generated for you are yours to use personally. You may not redistribute, resell, or commercially exploit generated content.

The BiteVisor name, logo, and visual identity are trademarks of BiteVisor. You may not use them without written permission.

12. User Content

By posting content to the community features, you grant BiteVisor a non-exclusive, royalty-free, worldwide licence to display, distribute, and reproduce that content within the Service for the purpose of operating the community.

You retain ownership of your content and may delete it at any time. Deleted content will be removed from the Service within a reasonable time, though cached copies may persist temporarily.

13. Limitation of Liability

To the maximum extent permitted by law, BiteVisor and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to health outcomes, data loss, or loss of profits.

Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty United States dollars (USD 50), whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, abuse of community features, or any other reason with reasonable notice where practicable.

Upon termination, your right to use the App ceases immediately. You may request a copy of your data within 30 days of termination by emailing support@bitevisor.com.

Sections that by their nature should survive termination (including Limitation of Liability, Intellectual Property, and Governing Law) will continue to apply.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification at least 14 days before they take effect.

Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and delete your account.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Zambia. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.

If negotiation fails, disputes shall be resolved in the courts of Lusaka, Zambia, which shall have exclusive jurisdiction.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
